Settlement Status

March 25, 2026

On March 25, 2026, the Superior Court of Québec approved the settlement.

You have until July 8, 2026 at 11:59 PM Eastern Time to submit your claim.

Am I Eligible?

In order to receive compensation under this Settlement, a person must:

  1. have purchased, anywhere in Quebec, between May 9, 2019 and February 11, 2026, a prepaid card such as the "Vanilla," "Perfect Gift" and "American Express" cards issued and/or distributed by Peoples Trust (a "Prepaid Card"); and
  2. have purchased the Prepaid Card as a consumer (i.e. not as a company); and
  3. not have opted-out of the Class Action; and
  4. complete the Claim Form by July 8, 2026 (the "Claim Deadline") in compliance with the instructions below, attesting that he or she purchased at least one Prepaid Card in Quebec during the Class Period, specifying the city in which the purchase was made, and providing a valid email address where an Interac e-Transfer can be sent. No other proof of purchase is required.

What the Settlement Provides

The Settlement Agreement provides for a payment of CAD $5,500,000 (the "Settlement Amount") by Peoples Trust in full and final settlement of the claims advanced in this class action. After deduction of Class Counsel Fees, administration expenses, notice costs, the Fonds d'aide aux actions collectives levy (if applicable), and any other approved costs, the remaining funds (the "Distribution Fund") will be distributed equally among approved claimants.

Compensation per Class Member

Each Class Member may obtain a payment in the form of an Interac e-Transfer equal to the Distribution Fund divided by the total number of Approved Claimants, between a minimum of $3.00 and a maximum of $100.00, depending on the total number of Approved Claimants. Each Approved Claimant can only get one Interac e-Transfer regardless of the number of Prepaid Cards they purchased during the Class Period, unless the Court orders a redistribution. If the total number of Approved Claimants results in Interac e-Transfers worth less than $3.00 each, no Interac e-Transfers will be made and the Distribution Fund will be paid to charities approved by the Court.

Payment Method

Payments are made by Interac e-Transfer to the email address provided on your Claim Form, after the close of the claim period and once all claims have been validated.

Commercial Practice Changes

In addition to the monetary settlement, the defendants have agreed to change how activation fees are displayed on Prepaid Card packaging:

  • The font size used for activation fees must be equal to or larger than the font used for the nominal value of the card.
  • The activation fees and nominal value must be displayed in the same area of the packaging.
  • Existing inventory may be sold through, with up to twelve months allowed to fully implement these changes.
  • The new practices remain in place as long as the relevant legislation is in force.
